A nadie en Colombia le puede quedar duda de la ilegalidad -dentro de las propias leyes “democráticas” del Estado sinárquico- del segundo mandato presidencial de Álvaro Uribe Vélez. Ilegalidad plenamente comprobada en un memorable fallo de la Sala Penal de la Corte Suprema de Justicia emitido el 26 de junio de 2008. La Corte en esta sentencia, relacionada con el delito de cohecho propio confesado por la hoy ex representante a la Cámara Yidis Medina, cometido en la votación definitoria del proyecto de reforma constitucional mediante el cual se reformó el artículo 197 de la Carta Política para incluir la figura de la reelección presidencial, concluye:
“Resulta inaudito que desde las altas esferas del poder de la época, por algunos de sus miembros, se impulse la desinstitucionalización al promover el quebrantamiento de las reglas básicas del modelo de Estado cuando en busca de un beneficio particular se impulsó a toda costa un Acto Legislativo, sin importar que para sacarlo avante se llegare hasta la comisión de conductas punibles... Las circunstancias de factum y de iuris que sirven de fundamento a la presente sentencia indican que la aprobación de la reforma constitucional fue expresión de una clara desviación de poder, en la medida en que el apoyo de una congresista a la iniciativa de enmienda constitucional se obtuvo a partir de acciones delictivas”(1).
La confesión –prueba reina- de la ex parlamentaria Yidis Medina ante la Corte Suprema de Justicia sobre cómo negoció su voto decisorio con el presidente Uribe (2) y sus cómplices –con el aval de la sinarquía dueña del Estado- para que se aprobara la reforma constitucional que permitió la reelección de Uribe, no es sólo un delito de cohecho sino otro crimen que evidencia la impune imbecilidad moral propia de las sinarquías dueñas del poder económico y de los Estados y de la necesaria protervia de sus testaferros en los diferentes estamentos del mal llamado “poder público”. Imbecilidad moral que se extiende, por ser su invención, al método fraudulento que le ha garantizado a las sinarquías la propiedad sobre los Estados: la “democracia” electoralista, una de cuyas herramientas es la manipulación total de la opinión a través del control del espectro electromagnético y de la alta tecnología de sus medios de comunicación, un control mediático absoluto, con lo cual se ha consolidado una cultura hipnótica y mentirosa favorable siempre a los grandes intereses económicos de las sinarquías, incluido el narcotráfico a nivel mundial, mientras la población permanece crónicamente en la pobreza y en la miseria o en una constante crisis económica. Sin embargo, en Colombia la sinarquía con este poder soporífero sobre la opinión sólo ha logrado encadenar o corromper aproximadamente al 45% del electorado pues el 55% restante históricamente se ha abstenido de participar en la farsa electoralista. Ese 45%, la minoría de la nación, ha sido utilizado para todo: para elegir presidentes, congresistas, gobernadores, etc.; para encuestas, referendos y plebiscitos; para prefabricar una oposición “democrática” y para todo tipo de multitudinarias movilizaciones y marchas que fortalezcan la imagen mesiánica y el poder esclavista de la sinarquía colombiana y sus capataces. En la reelección dolosa de Uribe en el 2006, éste obtuvo el 62% del 45% que vota, lo que equivale sólo al 28% del total (100%) de personas aptas para votar.
La subyugación de la conciencia a través del poder mediático es característica esencial de los Estados sinárquicos sin importar cuál sea su fachada ideológica. Todas las sinarquías, de “izquierda” o de “derecha”, no importa el ropaje con el que se tapen, son liberticidas, mafiosas, corruptas, opresoras y expoliadoras, y cuando lo consideran necesario son asesinas y genocidas, amparadas en la impunidad que les garantiza su perverso Estado de “derecho”, es decir, su Constitución y sus leyes. Como dijera un monarca inglés, “las leyes son para la plebe no para los príncipes”.
Para proteger plenamente su impunidad la sinarquía colombiana creo una instancia por encima de la Corte Suprema de Justicia: la Corte Constitucional. Esta Corte le hizo el quite al fallo de la Corte Suprema de Justicia sobre el delito de cohecho cometido por Yidis Medina para aprobar la reforma constitucional (acto legislativo No. 02 de 2004) que permitió la reelección de Uribe, decidiendo no reabrir el análisis de la legalidad de la reforma alegando que se habían vencido los términos para hacerlo, un engañoso tecnicismo que le ha permitido a Uribe la permanencia ilegal en la presidencia. Pero siempre quedan rendijas y la impunidad aprobada por los magistrados de la Corte Constitucional tuvo un salvamento de voto del magistrado Jaime Araújo Rentería que honra la verdad y la libertad y cuyo texto explicativo en algunos de sus apartes dice:
“(...) El voto de esta congresista fue definitivo y determinante para la aprobación del Acto Legislativo de la reelección, de manera tal que sin el voto de Yidis Medina no habría sido posible la reelección.
“(...) evidencia la Corte Suprema que el voto de Yidis Medina no se debió al valor de los argumentos o la capacidad de convencimiento, sino a las dádivas y promesas burocráticas aceptadas por la ex congresista, esto es, ‘... en virtud del ofrecimiento de sobornos ...’.
“(...) la Corte Suprema de Justicia concluyó en su sentencia que un delito influyó en una reforma constitucional que dio paso a la reelección presidencial.
“(...) Es decir, la Corte Suprema de Justicia está reafirmando un principio universal del derecho, en el sentido de que el delito no es fuente de derecho y no puede originar actos jurídicos válidos, y por tanto, que dichos actos jurídicamente nada valen.
“De todo lo expuesto en la sentencia de la Sala Penal de la Corte Suprema de Justicia, el suscrito Magistrado concluye:
(...) que se configuró la comisión de un DELITO DE COHECHO, y que tal actuación ilícita y criminal fue determinante para la aprobación del Acto Legislativo No. 02 del 2004; es necesario concluir que el Acto Legislativo se encuentra viciado por la comisión de un delito, lo cual genera una NULIDAD que es por lo demás una NULIDAD ABSOLUTA, INSUBSANABLE E IMPRESCRIPTIBLE.
“(...) que el actual Gobierno Nacional es ilegal y se encuentra usurpando el poder político y jurídico...
“(...) Todos los actos de gobierno que realicen tanto el presidente, como sus ministros y su equipo de gobierno se encuentran viciados de inconstitucionalidad e ilegalidad; razón por la cual se encuentra justificada desde el punto de vista iusfilosófico la desobediencia civil.
“(...) Si no existe JURÍDICAMENTE, sino de facto la reelección presidencial, todo lo realizado por el Gobierno no tiene ningún efecto, todos esos actos de gobierno son ilegítimos. El deber de obediencia de todos los ciudadanos se rompe y cesa la obligación de acatar sus actos y sus personas. A partir de la sentencia de la Corte Suprema, los títulos de Presidente, Vicepresidente o Ministro han fenecido y si son usados, están siendo usurpados... El deber de respeto a la autoridad o a la ley finaliza en la teoría constitucional, frente a acciones injustas, ilegales o inválidas.
“(...) De este modo, ni el presidente es ya el presidente, ni el vicepresidente es vicepresidente, ni los ministros son ya los ministros, ni hay reelección, ni primera, ni segunda, y todo lo que se hizo es ilegal; por ello es que nos encontramos en una situación inconstitucional, ya que todo el gobierno está actuando gracias a un acto ilegal, por ello es que nos encontramos en una situación inconstitucional”(3).
Sólo las contradicciones en el seno de la sinarquía y sus escuderos logran, de cuando en cuando, sacar a la luz sus crímenes como ocurrió en el caso Yidis Medina-Uribe Vélez. Sin embargo, el dolosamente reelecto presidente Uribe continúa impúdica e impunemente en su cargo y ni por guardar las apariencias ante el siempre cautivo y engañado pueblo colombiano la sinarquía ha hecho que renuncie, pues lo considera el mejor factótum que ha tenido en mucho tiempo; por ello la sinarquía ha utilizado todos los medios populistas a su alcance, incluidos sus medios de comunicación, para montar un grotesco culto a la personalidad del “presidente” Uribe al mejor estilo maoísta, sin antecedentes en la historia colombiana.
Además de la hiperbólica exaltación diaria, donde se le califica como el “salvador”, el “único”, el “irreemplazable”, el “gran protector”, etc., el alter ego de Uribe en la Casa de Nariño, el señor José Obdulio Gaviria, primo hermano del gran capo del narcotráfico Pablo Escobar Gaviria, en el colmo de la megalomanía uribista creó una fundación de “izquierda” consagrada únicamente a dicho culto llamada Fundación Centro de Pensamiento Primero Colombia cuya función es publicar y difundir la colección titulada “Las ideas de Uribe”, con miras a convertirlas en pensamiento único. Como informó El Espectador, José Obdulio Gaviria instó a sus secuaces en la fundación a “ser ‘un ejército de publicistas de la doctrina’ del presidente, que según él tendrá influencia en el país al menos durante los próximos 50 años”(4). Para comprender mejor lo anterior es necesario recordar que José Obdulio Gaviria fue cofundador del extinto movimiento de “izquierda” Firmes y según el ex guerrillero León Valencia, “había sido militante del clandestino PCC ML cercano a las guerrillas maoístas de la época”(5).
Consecuente con los lineamientos del culto a la personalidad de Mao Tsetung en la China comunista, José Obdulio Gaviria le encargó esa abyecta labor en la fundación que él preside a tres veteranos militantes del maoísmo colombiano, los camaradas Libardo Botero (compilador), Fernando Alameda (director ejecutivo) y Gonzalo España (historiador) quienes fueron (¿son?) dirigentes del MOIR (Movimiento Obrero Independiente y Revolucionario), partido político seguidor del marxismo-leninismo pensamiento Mao Tsetung. Al parecer estos camaradas han encontrado en Uribe un nuevo “Gran Timonel” y han decidido recopilar y sacralizar sus ideas, consideradas por ellos de “izquierda”, en 20 volúmenes (6). En la reseña sobre el compilador Libardo Botero, se lee: “Desde sus épocas de estudiante universitario y hasta hace algunos años militó en el MOIR. En su condición de luchador de la izquierda colombiana apoyó desde un comienzo la candidatura de Álvaro Uribe Vélez”. Entremezclado entre “Las ideas de Uribe” en los volúmenes se encuentran artículos del fallecido jefe máximo del MOIR Francisco Mosquera (7). Todo esto deja ver claramente la gran influencia que ha tenido el maoísmo criollo en “Las ideas de Uribe” y en el culto a la personalidad del espurio presidente de los colombianos.
Al interior de la “izquierda” colombiana, esto es, del totalitarismo marxista-leninista, (toda “izquierda” es estatista, es decir, totalitaria y por tanto enemiga de la libertad individual), continúa el caduco conflicto ideológico entre el finiquitado comunismo línea Moscú encarnado todavía en Colombia en el Partido Comunista y su criatura las FARC y la línea Pekín, línea ortodoxa del maoísmo, representada hasta hoy por algunos miembros de la intelligentsia del viejo MOIR, ahora en el uribismo como se anotó. La línea Pekín, los maoístas, consideran que los comunistas modelo soviético, hoy castro-chavistas, traicionaron la “revolución” por diversas razones y que ellos son los verdaderos “revolucionarios”, como lo demuestra el asombroso crecimiento y el expansionismo económicos del totalitarismo chino, que tiene al borde del colapso al mundo capitalista occidental. Sin embargo, otras facciones del desmembrado MOIR ingresaron al Polo Democrático Alternativo (PDA) –organización de la “izquierda” antiuribista- donde se unieron con el Partido Comunista castro-chavista y otros grupúsculos de “izquierda”. Esta organización y otros grupos de “izquierda” -aliados de hecho del PDA- como la Alianza Social Indígena y el Movimiento Podemos Cali se han tomado una buena parte del poder del Estado a través de la contienda electoralista y hoy controlan las tres principales alcaldías de Colombia, las de Bogotá, Medellín y Cali, y varias gobernaciones; tienen una fuerte representación en el Congreso, en asambleas departamentales y concejos municipales, además de alcaldías en ciudades intermedias y pequeñas poblaciones, etc.
El enemigo común tanto de la “izquierda” uribista como de la “izquierda” antiuribista son los grupos confederados de legítima defensa que desde hace 25 años se levantaron en armas contra la liberticida guerra irregular subversiva desatada por la hoy “izquierda” castro-chavista y su ejército guerrillero las FARC, quienes utilizan la vieja táctica leninista de la combinación de todas las formas de lucha legales e ilegales. Como apéndices de las FARC existen otros grupos guerrilleros menores como el ELN. Por tanto, en la guerra contra los grupos libertarios que ejercen su derecho humano a la agresión defensiva, la “izquierda” castro-chavista contó y cuenta con el apoyo soterrado de la “izquierda” uribista. No obstante, la legítima defensa campesina estaba derrotando a la “izquierda” castro-chavista. Por esto la “izquierda” de la Casa de Nariño buscó la forma de acabar con los grupos libertarios desmovilizándolos. Para ello recurrió al maquiavélico Uribe, quien con todo tipo de argucias, promesas, leyes supuestamente favorables, etc., logró convencer a los narcotraficantes que por asuntos de negocios lo habían apoyado electoralmente y en ese momento habían comprado la comandancia de la mayor parte de los grupos de legítima defensa, para que traicionaran a sus tropas e hicieran que se entregaran y depusieran sus armas. Conseguido este objetivo, el “Gran Timonel” criollo y sus secuaces de “izquierda”, obviamente, no cumplieron lo acordado.
Los políticos -grandes electores- y los funcionarios que por una razón u otra a nivel regional apoyaron la legítima defensa y a nivel nacional, al igual que los narcotraficantes, hicieron campaña para elegir y reelegir a Uribe sin conocer las componendas palaciegas del “Gran Timonel” con José Obdulio Gaviria y su grupo de “izquierda” maoísta, también fueron engañados, traicionados y encarcelados. La gran mayoría del uribismo y otros sectores políticos creen patética e ingenuamente que Uribe es enemigo de la “izquierda”. De esta manera, la “izquierda” uribista, desde la Presidencia, le asestó un fuerte golpe a la guerra justa de la legítima defensa campesina, favoreciendo la guerra irregular de la “izquierda” castro-chavista su contradictor en el seno del marxismo-leninismo, “contradicciones que no son antagónicas”, diría Mao Tsetung.
Superada así temporalmente la guerra a muerte con el enemigo común de la “izquierda” colombiana queda por resolver la contradicción entre la “izquierda” uribista y la “izquierda” antiuribista, encarnada esta última en el PDA, las FARC y sus adláteres. Esto explica la ahora sí prioritaria ofensiva desde la Presidencia contra la oposición de “izquierda” y en particular contra las FARC a través de la mal llamada política de “seguridad democrática”, que por fin le propinó dos certeros golpes de ablandamiento a esa guerrilla: la muerte de Raúl Reyes, miembro de la dirección colegiada de las FARC, y la liberación, después de más de seis años de secuestro, de la ex candidata presidencial Ingrid Bentancourt. Falaz política de “seguridad democrática” que ha sido incapaz de regresar a sus tierras o a sus hogares a tres millones de desplazados por la guerra irregular que vive Colombia. Cifra que aumenta cada día.
Además del intento de ablandamiento sicológico-militar para mantener la supremacía uribista dentro de la “izquierda”, los empresarios uribistas prochinos le están abriendo las puertas al expansionismo económico del totalitarismo chino en Colombia y en el resto de América Latina a través de su participación en proyectos como el denominado New China Pier Business Development Centers y en negocios como los que sostienen con la ZTE Corporation el mayor fabricante de equipos de telefonía de China que tiene alianzas y contratos con grandes operadores como Telecom, ETB, Edatel y la Red Multiservicios de Telecomunicaciones de Emcali, etc. (8).
En esta lucha por la preeminencia en el poder entre las dos tendencias de “izquierda”, entre el modelo chino-uribista y el castro-chavista, la llamada Fuerza Pública y el oportunista ministro de Defensa Juan Manuel Santos han tenido un papel de idiotas útiles de la “izquierda” entronizada en el Palacio Presidencial con José Obdulio Gaviria, favorito del ilícitamente reelecto Uribe Vélez.
El propósito de la “izquierda” uribista, con el aval de la pragmática sinarquía colombiana, es, después de debilitarlo, unirse con su contradictor el PDA-FARC y sus amigos mediante una Asamblea Nacional Constituyente, la cual desde ya tiene la aprobación de Fidel Castro y Hugo Chávez. Para su realización Uribe cuenta con su nuevo “ministro” del Interior y de Justicia Fabio Valencia Cossio, un reconocido componedor e interlocutor de las FARC, quien durante las negociaciones del presidente Andrés Pastrana con los jefes del ejército subversivo en San Vicente del Caguán era la ficha presidencial de las FARC para la “refundación del Estado”, como quedó consignado en 1999 en un acuerdo secreto plasmado en un documento de 15 puntos que fue develado por la revista La otra verdad periodismo investigativo del mes de julio de 2007. Allí se lee: “El documento de 15 puntos de la organización subversiva se denomina ‘Carta de Intención entre las FARC-EP y el gobierno nacional’ en la cual los hombres dirigidos por Manuel Marulanda Vélez -‘Tirofijo’-, Alfonso Cano y Raúl Reyes aclaran que están dispuestos a movilizar a todos sus miembros para apoyar la candidatura presidencial de Fabio Valencia Cossio”. Cuando se refiere a la Asamblea Nacional Constituyente el pacto secreto en su punto 4 dice: “Esta Asamblea producirá una nueva Constitución nacional... y su objetivo sería la refundación del Estado colombiano”(9). Y con ello vendrá el cogobierno de la “izquierda” chino-uribista y la “izquierda” castro-chavista, el cual será el nuevo ropaje de la sinarquía* colombiana.

*Sinarquía es el grupo de personas dueñas del capital financiero, de las corporaciones, de los monopolios, de los grandes negocios y del Estado, que deciden en beneficio propio los asuntos políticos y económicos de un país a través de ese Estado.
